====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 15-09-2017 Heard Smt. Bela Singh, learned counsel for the petitioner and Smt. Pushpa Singh , learned Additional Public Prosecutor. The sole petitioner, who is in custody since 6.6.2017 in Raghopur P.S. Case No. 09 of 2017 registered for the offence under Section 30A of the Bihar Prohibition and Excise Act , 2016 has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that nothing was recovered from conscious possession of the petitioner. Only on an allegation that from outside house of the petitioner about 180 liters of Indian make foreign liquor was seized by the police petitioner was made accused and after noticing the fact that petitioner was made accused, petitioner voluntarily surrendered on 6.6.2017 and he is in custody since

Patna High Court Cr.Misc. No.41628 of 2017(2) dt.15-09-2017 2/2 then. Learned counsel for the petitioner has also referred to paragraph no. 3 of the petition to show that petitioner is having clean antecedent.

Considering the nature of accusation, clean antecedent of the petitioner as well as period of custody, let the petitioner Chandan Kumar @ Chandan @ Channa be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, II-cum- Special Judge, Vaishali / concerned court in connection with Raghopur P.S. Case No. 09 of 2017.
