Allegation as per FIR is that police on information of preparation of dacoity raided the place of occurrence and found stolen property in possession of the accused persons and one accused Sonu Kumar was arrested and from whose possession one rifle was recovered and he disclosed that the rifle was of the petitioner.
Submission of learned counsel for the petitioner is that except the aforesaid statement there is nothing against the petitioner and there is no recovery from his possession and he

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Nalanda at Biharsharif, in connection with Rajgir P.S. Case No. 5 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
