The petitioner apprehends his arrest in connection with Madhubani Town P.S. Case No.459 of 2022 registered under Sections 272, 273, 414 and 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from possession of the petitioner. The seized motorcycle does not belong to the petitioner.

Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the

No.18800 of 2023(2) dt.19-05-2023 2/2 parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II-cum-Special Judge, Excise Act, Madhubani in connection with Madhubani Town P.S. Case No.459 of 2022 corresponding to G.R. No.2269 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Arvind Srivastava, J) Harish/- U T
