The petitioner is apprehending his arrest in connection with Sadar (Mufassil) P.S.Case No.158 of 2018 registered for offences punishable under Sections 147, 148, 149, 341, 323, 307, 504, 506, 448 of the Indian Penal Code.

Allegation against the petitioner is of assault by rod on the head of the informant.

Submission of the learned counsel for the petitioner is that there is case and counter case between the parties. Heard learned A.P.P. and the learned counsel for the informant. They have opposed the prayer for bail stating that the impugned order itself shows that fracture on the right scapula has been found on the person of Bhola Yadav and multiple ribs

Patna High Court Cr.Misc. No.35081 of 2018 (2) dt.09-07-2018 2/2 fracture were also found.

Having heard both sides and in view of the facts and circumstances, as stated above, this is not a case for grant of anticipatory bail rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its without being prejudiced by the order of this Court.
