Five petitioners, apprehending their arrest in connection with Farbesganj P.S. Case no.696 of 2015 registered for the offence under Section 307 and other allied Sections of the Indian Penal Code, have prayed for grant of anticipatory bail. It was submitted by learned counsel for the petitioners that petitioners side and the informant side are Pattidars and they have been falsely implicated in this case, whereas learned Addl. Public Prosecutor, opposing the prayer of the petitioners
Patna High Court Cr.Misc. No.19720 of 2016 (2) dt.20-05-2016 2/2 submits that the petitioners are named in the F.I.R.. and so far petitioner no.4 is concerned, there is specific accusation against him in the F.I.R.
Besides hearing learned counsel for the parties, I have also perused the materials available on record. After going through the same, petitioner nos. 1, 2 and 3 can be extended the privilege of anticipatory bail. So far petitioner nos. 4 and 5 are concerned, their prayer for anticipatory bail stands rejected. They may appear before the court below and pray for regular bail. Let petitioner nos. 1,2 and 3, namely, Smt. Pinki Devi @ Pinki Devi, Smt. Puja Devi @ Puja Devi and Khushbu Kumari, in the event of their arrest or surrender within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Farbesganj P.S. Case no.696 of 2015, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
