Case No. 274 of 2017, registered for offences punishable under Sections 272, 273 and 120 of Indian Penal Code and Section 30, 38 and 47 of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioners is of recovery of 240 litres of country made liquor from the car in which they were traveling.

It has been submitted on behalf of the petitioners that they have falsely been implicated in this case and nothing ahs been recovered from their conscious possession and they have no criminal antecedents and have been in judicial custody since

Having heard both sides, considering the facts and circumstances of the case, nature of allegation, this application is disposed of with direction to the court below to release the petitioners on bail to his own satisfaction after completion of five months of judicial custody of the petitioners.
