Mr. Aditya Narayan Singh 1, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 05-07-2018 Heard learned counsel for the petitioners and learned counsel for the State.
In this case, the petitioners are seeking anticipatory bail in connection with Chautham P.S. Case No. 23 of 2018, registered for the offence punishable under Sections 147, 186, 224, 225, 332, 341, 323, 353, 504 and 506 of the Indian Penal Code.
As per the F.I.R., the Police has received the information that Amar Kumar was taking tea near Durga temple, the Police party came there and lifted him. While the Police party taking the accused to the Police Station, the persons
Patna High Court Cr.Misc. No.37399 of 2018(2) dt.05-07-2018 2/3 named in the F.I.R. assembled and started applying the force against the Police party, thereby the accused escaped from the clutches of the Police party.
Learned counsel for the petitioners submits that the petitioners are no concerned or no connection with the accused persons, but on account of village politics they have implicated as accused persons in the present case.
Considering the fact that petitioner nos. 2 to 5 are ladies, let the above-named petitioner nos. 2 to 5, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Khagaria, in connection with Chautham P.S. Case No.23 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. Further condition is that whenever the police will call the petitioner nos. 2 to 5 for the purposes of investigation and interrogation, they will remain present for the investigation. In the event of being absent on two consecutive dates without reasonable explanation, the present order will be treated to have been cancelled.

However, if the petitioner no. 1 surrenders before the Court below within four weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
