ANJANA MISHRA ORAL ORDER 24-06-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 302/201/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that these petitioners are the family members of the deceased from her matrimonial side and they have been living separately in mess and residence. It is further submitted that when the condition of deceased-victim deteriorated, she was admitted in a hospital at Muzaffarpur and treated properly, which is evident from
Patna High Court Cr.Misc. No.19554 of 2016 (3) dt.24-06-2016 P2/2 Annexure-3 series. It is further submitted that the marriage, in question, took place way-back in the year 2006 and there was no demand for dowry earlier.
Considering the aforementioned facts and circumstances and that these petitioners are living separately, let the petitioners above named, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sadar, East Champaran, Motihari in connection with Rajepur P.S. Case No. 132/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
