JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-10-2017 The petitioner seeks regular bail in connection with Tajpur (Halai O.P.) P.S. Case No. 236 of 2017, registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 38(1), 3892), 41(1) and 30(a) of the Bihar Prohibition and Excise Act, 2016.
Allegation is of recovery of 1246 litres of liquor from the Scorpio and Alto vehicle.
It has been submitted on behalf of the petitioner that petitioner happens to be the father of co-accused of this case and the vehicles belong to co-accused. Petitioner has nothing to do with the alleged recovery and has falsely been made accused in this case. Further he has no criminal antecedent and has been in judicial custody since 07.08.2017.

Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with the direction to the court below to expedite the trial and try to conclude it within a period of six months and if the trial is not concluded within the aforesaid period, the trial court shall release the petitioner to his own satisfaction.
