====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-05-2023 Heard learned counsels for the petitioners and the State.

Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 504, 307/34 of the Indian Penal Code.

It is alleged that all the F.I.R. named accused persons including these petitioners demanded money from the informant and abused and assaulted him, his wife and his father-in-law by means of iron rod, danda.

Petitioner No. 1 is father and petitioner No. 2 is brother-in-law of the informant.

Learned counsel appearing for the petitioners submits

Patna High Court CR. MISC. No.16652 of 2023(2) dt.19-05-2023 2/2 that specific accusation of assaulting the informant and his family members is against other accused persons. So far these petitioners are concerned, allegation of assault against them is general and omnibus.

Considering the nature of allegation, this anticipatory bail is allowed and it is ordered that the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VI, Bhojpur at Ara in connection with Chauri P. S. Case No. 60 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
