JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-08-2019 The case is under Section 498A IPC and it appears from the record that the matter was referred to the Patna High Court Mediation and Conciliation Centre vide order dated 17.6.2019 and the Mediator's report at Flag 'X' disclosed that the dispute has been resolved between the parties in terms of settlement mutually agreed between the parties and terms of settlement disclosed that both the parties decided to live separately on condition of payment of Rs.10 lac to opposite party No.2, out of which first instalment of Rs.3.5 lac shall be paid at the time of filing of petition under Section 13B of Hindu Marriage Act within one month by way of Demand Draft, second instalment of Rs.3.5 lac will be paid to opposite party No.2 at the time of recording of statement of both the parties and rest Rs.3 lac will be paid to opposite party No.2 at the time of passing of

Patna High Court CR. MISC. No.18924 of 2019(5) dt.19-08-2019 2/2 decree of divorce.

Both the parties have admitted the above fact. Heard learned APP also.

In view of above facts and circumstances, let petitioner surrender in the court below by 28.8.2019 and on surrender he sahll released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Danapur, in connection with Complaint Case No. 740(C) of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner shall abide by the terms and condition of the agreement reached between the parties, otherwise opposite party No.2 is at liberty to move before the court below for cancellation of bail bonds of the petitioner. Let copy of the order of Mediator along with the memorandum of agreement be sent to the court concerned for needful.
