Petitioner seeks bail in a case registered under Sections 363, 366A of Indian Penal Code.

It is submitted by the counsel for the petitioner that when the informant's daughter did not return from tuition then she went to search her at the house of Pankaj Kumar who was the tutor. On going there, they met the father and the mother of tutor Pankaj. It is further submitted that the father and mother of Pankaj disclosed to the informant the fact that both Pankaj and daughter of the informant has eloped for marriage and that they should take steps in the matter as they are capable of. No.37130 of 2017 (2) dt.10-08-2017 2/2 the counsel for the petitioner that this conduct of father and mother of co-accused Pankaj as is apparent from the allegation made in the first information report, shows their bona fides. They are in no way concerned with any criminal offence. They are father and mother of the tutor and have falsely been implicated in the case. It is next submitted that there is no criminal antecedent against the petitioner since before and in the aforesaid case, he is languishing in jail since 27.05.2017 merely for the fact that he is father of coaccused Pankaj. Considering the aforesaid submissions, petitioner's prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate V, Samastipur in Samastipur (Mufassil) Police Station Case No 274 of 2017.
