The petitioner, already in custody, seeks bail in connection with Maker P.S. Case No. 21 of 2018 registered under Sections 448, 341, 323, 379, 304, 504/34 of the Indian Penal Code.

Allegation is brief is that on account of land dispute the petitioner gave iron rod blow over the head of the informant and prior to that Shyam Bahadur Singh abused and dragged him by putting scarf around his neck and accused Ganesh Singh gave lathi blow due to which he became unconscious. Learned counsel for the petitioner submits that there is land dispute between both side. Allegation is false that petitioner gave iron rod blow over the head of the informant as no external

Patna High Court Cr.Misc. No.35606 of 2018(2) dt.21-06-2018 2/2 injury was found in post-mortem report on the person of deceased. Rather, one of the witnesses has stated that petitioner pushed him and he fell on the ground. The informant was 80 years old person. Petitioner is in custody since 19.02.2018 and he has no criminal antecedent.

Having considered the aforesaid facts and circumstances, specially there is no external injury on the head was found on the person of the deceased. Let the petitioner, namely Ganu Singh @ Gonu Singh is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-XII, Saran at Chapra, in connection with Maker P.S.
