====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-07-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Kursakanta P. S. Case No. 26 of 2023 in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code, Sections 3/4 of the Dowry Prohibition Act and Section 27 of the Arms Act.

3. As per the prosecution case, this petitioner, on the provocation of co-accused Md. Azharuddin, fired upon the husband of informant, as a result of which he died.

4. Learned counsel for the petitioner denies the prosecution case and submits that petitioner is a retired army

Patna High Court CR. MISC. No.18505 of 2025(3) dt.11-07-2025 2/2 personnel and own father of the deceased. He further submits that petitioner has falsely been implicated in this case by the informant with an ulterior motive. Petitioner is in custody since 07.01.2025.

5. Learned A.P.P. for the State vehemently opposed the bail application. It is submitted that petitioner is sole assailant and he shot dead his own son.

6. Considering the nature of accusation, prayer for bail of the petitioner is refused.
