This application is for grant of regular bail in connection with Madhuban P.S.Case No.134 of 2017, for the offences punishable under Sections 413, 414/34 of the Indian Penal Code.
Allegation against the petitioner as per FIR is that he was caught by the police along with the stolen motorcycle. Submission of the learned counsel for the petitioner is that he was not aware of the fact that the motorcycle was stolen one rather the person who was sitting behind him asked him to get the motorcycle checked and he fled away when the police apprehended him. The petitioner has no criminal antecedent and he has remained in custody for about three months. Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.39425 of 2017 (2) dt.22-08-2017 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to release the petitioner in connection with Madhuban P.S.Case No.134 of 2017 to the satisfaction of 4th A.C.J.M., East Champaran at Motihari, once the charge is framed in this case or completion of six months period of the petitioner in custody, whichever is earlier on his own satisfaction.
With the aforesaid observation, this application is disposed of.
