2. The petitioner seeks bail in connection with Araria P.S. Case No. 211 of 2025 registered for the offence under Sections 103(1) and 3(5) of the BNS.

3. As per the prosecution case, the accused persons are said to have assaulted the victim and have killed him. The petitioner is in custody since 23.11.2025.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and has falsely been implicated in this case. He further submits that the deceased died because of liver injury and in the facts of the case, no offence under Section 103(1) of the BNS is made out against the petitioner. He further submits that there was no intention of the accused persons of killing the deceased as there is no injury found upon the body of the deceased which is caused by a weapon except bamboo sticks. He also submits that from the

5. Considering the aforesaid facts, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court below in connection with Araria P.S. Case No. 211 of 2025.

7. As a condition of this order, the petitioner, after being released on bail, is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.

8. It is made clear that in case, any of the accused does not appear in the trial then the trial of other accused persons shall not be delayed and the trial of the absent accused shall be held in-absentia as per law.
