The petitioner apprehends his arrest in connection with Rajauli P.S. Case no. 184 of 2015, registered under Sections 147, 149, 337, 353, 224 and 225 of the Indian Penal Code. The accusation is that informant being the Excise Inspector raided the house of Raj Kumar Chaudhary, Gita Chaudhary and this petitioner. In course of search about 300 liters of country made liquor recovered, where 10-12 persons also present taking the liquor. At that time, 20 to 25 supporters of the seller of the liquor came and set free the apprehended persons and started pelting stones on the informant in which slight injury was sustained by the informant.

No.41116 of 2017 (3) dt.15-12-2017 2/2 Learned counsel for the petitioner submits that, in fact, the alleged liquor was recovered by the informant in the village from barren place, but with ulterior motive, the petitioner and others have been implicated in this case. Further submission is that similarly situated co-accused Raj Kumar Chaudhary and Gita Chaudhary @ Gita Devi have already been granted privilege of Anticipatory Bail on 18.07.2017 vide Criminal Miscellaneous No. 15464 of 2017 by this Court. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in connection with Rajauli P.S. Case No.184 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
