JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Doriganj P.S. Case No. 165 of 2018, registered for the offences punishable under Sections 341, 323, 332, 307, 427, 504, 506 and 353/34 of the Indian Penal Code. Allegation as per FIR is that while the police party were checking the vehicle one truck came and dashed the barricade put by the police and due to which some police personnel received injuries and the persons assembled there got the accused persons fled away.

Submission of learned counsel for the petitioner is that he has falsely been implicated showing him as the driver of the truck he has been made accused and the owner of the vehicle and other accused persons have been granted anticipatory bail. Heard learned APP also, who has opposed the prayer

Patna High Court CR. MISC. No.18129 of 2019(2) dt.02-04-2019 2/2 for anticipatory bail of the petitioner.

From perusal of the impugned order it appears that there is specific allegation against the petitioner that he was in drunken condition and was driving the truck at a high speed and broke the barricade.

In such view of the matter, let petitioner surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.

With the above observation, this application is dismissed.
