JUSTICE BIRENDRA KUMAR ORAL ORDER 27-06-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offence punishable under Sections 379 and 120B/34 of the Indian Penal Code.

The F.I.R. of the occurrence of theft is against unknown. The petitioner is accused in several cases of theft. Submission is that the petitioner is in custody since 04.12.2017. Nothing has been recovered from possession of the petitioner. Only material against the petitioner is suspicion. Considering the entire facts of this case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Madhepura P.S.

Patna High Court Cr.Misc. No.35783 of 2018 (2) dt.27-06-2018 Case No. 738 of 2017, with condition that both the bailors shall be the resident of territorial jurisdiction of the court-below and the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
