The petitioner seeks bail in Mushahari P.S. Case No. 191 of 2020, registered for the offence punishable under Section 394 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, while the informant was returning back to his home on his motorcycle, on the way three miscreants on the point of pistol looted cash of Rs. 13000/- from is possession. Informant raised alarm, on hearing the noise some people gathered and after seeing them miscreants doing firing fled away.
It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of investigation, name of this petitioner has come in this case. No looted article has been recovered from possession of this
Patna High Court CR. MISC. No.16885 of 2022(2) dt.25-05-2022 2/2 petitioner. No test identification parade has been held till date. Petitioner is in custody since 19.01.2021. Investigation is complete.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Xth, Muzaffarpur in connection with Mushahari P.S.
