JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Yogapatti ( Nawalpur) Police Station Case No. 155 of 2013 registered for the offences punishable under Section 341, 323, 313, 379/34 of the Indian Penal Code.

There is specific allegation against the petitioner that she assaulted the informant on her abdomen causing miscarriage to her and, therefore, I do not feel it proper to grant anticipatory bail to the petitioner and accordingly, her prayer for bail in connection with Yogapatti ( Nawalpur) Police Station Case No. 155 of 2013, pending in the court of Chief Judicial Magistrate, Bettiah, West Champaran stands rejected.

However, it is made clear that if petitioner surrenders

Patna High Court Cr.Misc. No.11191 of 2015 (3) dt.18-05-2015 2/2 and seeks regular bail within four weeks from today, the concerned court shall consider the regular bail application of the petitioner on its own merit without being prejudiced by this rejection order particularly, keeping in mind that petitioner is a lady and the informant has already compromised this case.
