The petitioners, who are aged about 21 and 22 years, respectively, are in custody in connection with Bettiah Mufasil P.S. Case No. 269 of 2019 for the offence under Section 392 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioners would submit that the first information report was lodged against unknown and the names of the petitioners surfaced on the confessional statement of the co-accused. Learned counsel further submits that there is no recovery of any incriminating materials from possession of the petitioners. The petitioners are
Patna High Court CR. MISC. No.17511 of 2020(2) dt.02-06-2020 2/2 in custody since 20.06.2019.
Considering the fact that the petitioners were not named in the FIR and they have remained in jail for about one year, the Court is inclined to grant bail to them. The petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Mufasil P.S. Case No. 269 of 2019, subject to the condition that on release, the petitioners shall render their services as volunteers in the District Health Centre for a period of three months in dedicated Covid hospital. They are required to report the District Nodal Officer in the concerned region who shall utilise the service of the petitioners appropriately.
