In this application for anticipatory bail the petitioner apprehends his arrest in a case punishable for the offence under section 366 (A) of the I.P.C.

Allegedly the minor daughter of the informant was kidnapped by the petitioner with the aid and assistance of his family members. After investigation the victim has been examined under section 164 Cr.P.C. wherein she has stated that she was not kidnapped rather she had arranged marriage with Ranbir Yadav. She stated her age 20 years, whereas, the Magistrate has assessed her age as 18 years.

In the facts and circumstances as stated above, the

No.30478 of 2014 (2) dt.21-01-2015 2/2 petitioner in case of his arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Khagaria in Khagaria (Muffasil) P.S. Case No. 667 of 2012, subject to the conditions as laid down in section 438 (2) Cr.P.C.
