JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under sections 147,148,149,307 and 302 of the Indian Penal Code and sections 3(1)(ii) and (v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

It is alleged that the petitioners came variously armed, assaulted the informant and his wife when the son and daughter of informant came to rescue then they were also assaulted. Subsequently, during treatment the son of the informant

Patna High Court Cr.Misc. No.23974 of 2015 (2) dt.09-07-2015 2/2 succumbed to the injury.

It is submitted by learned counsel for the petitioners that for the occurrence of 24.2.2015 the FIR was registered on 7.3.2015 and the FIR reached to the learned court below on 9.3.2015.

Considering the nature of accusation, this court is not inclined to grant anticipatory bail to the petitioners in connection with Bikramganj P.S. Case No. 38 of 2015 pending in the court of learned SDJM, Bikramganj, Rohtas.

This application is, accordingly, dismissed.
