====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 13-05-2026 Heard Mr. Pintu Kumar Patel, learned counsel for the petitioner and the State.

2. The petitioner is in custody in connection with Lakhanour P.S. Case No. 02/2026 corresponding G.R. No. 22 of 2026 for the offence punishable under sections 126(2), 318(4), 179, 351(2) of the B.N.S.

3. As per the prosecution story, the informant alleged that this petitioner came along with two others and wanted purchase of the buffalo. As she told them that she is not in a mood to sell the buffalo, they sat there, asked about the home affairs and later, forced her to sell the buffalo for a consideration amount of Rs. 79,000/-, gave Rs. 70,000/- and wanted the rest of the payment to be made later on. The accused person too went away with the buffalo. Later, she found that all the notes that have been provided to her are forged/ duplicate. This led to the FIR.

4. Learned counsel for the petitioner submits that he has already suffered by being in custody since 05.01.2026, has no criminal antecedent. Further, the submission is that without accepting the allegation and/or the outcome of the present petition, the petitioner on its own would like to contribute Rs. 75,000/- through Demand Draft issued by the local branch of the State Bank of India/any Nationalized Bank to be submitted before the 'NAZARAT' of concerned Court to be handed over to the lady-informant after checking the credentials.

5. Learned APP opposes the prayer for bail submitting that an innocent lady has been duped by him.

Though allegation is there against this petitioner, he is in custody since 05.01.2026, has no criminal antecedent, this Court is inclined to extend him the privilege of bail with conditions subject to payment of Rs. 75,000/- as undertaken by the learned counsel for the petitioner to be paid by Demand Draft of local branch of the State Bank of India/any Nationalized Bank to be submitted to the Trial Court.

Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned District and Additional Sessions Judge-III, Jhanjharpur in connection with Lakhanour P.S. Case No. 02/2026 corresponding G.R. No. 22 of 2026 subject to the following conditions:

Patna High Court CR. MISC. No.18568 of 2026(3) dt.13-05-2026 3/3 (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

(iii) the petitioner shall appear before the concerned police station every fortnight for six months to mark his attendance and at the end of the period, the certificate be submitted to the Court; (iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Vijay Singh/Sanny Patel U T
