Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners apprehend their arrest in Majhauliya P.S. Case No. 528 of 2019, registered for the offences punishable under Sections 341, 323, 324, 307, 379, 447 and 34 of the Indian Penal Code.
Petitioner no. 1 is alleged to have assaulted Bhulai Sah by iron rod and petitioner no. 2 is alleged to have assaulted the wife of informant with fists and slaps.
Patna High Court CR. MISC. No.15006 of 2020(2) dt.02-07-2020 2/2 It is submitted that petitioners have been falsely implicated in this case. There is case and counter case. Injuries found on the person of Bhulai Sah is superficial. Petitioners have got clean antecedent.
Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Majhauliya P.S. Case No. 528 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
