In this case, the petitioner is seeking regular bail in connection with Panjwara P.S. Case No.04 of 2016, registered for the offence under Sections 395 and 397 of the Indian Penal Code.

As per the F.I.R., while the informant along with one Rupesh Jain was returning by Bolero vehicle after making collection, at that time, five to six unknown persons intercepted them and took away the money and mobile phone and fled away. The name of the petitioner has surfaced during investigation as co-accused Niranjan Yadav @ Niro Yadav in his

Learned counsel for the petitioner submits that coaccused Niranjan Yadav @ Niro Yadav has been granted bail by this Court in Criminal Miscellaneous No.26455 of 2017 vide order dated 07.07.2017 and other accused persons have also been granted bail by this Court. He further submits that the petitioner is in custody for more than one year. Considering the fact that co-accused Niranjan Yadav @ Niro Yadav, on whose statement statement the name of this petitioner has surfaced in this case, has been granted bail by this Court in Criminal Miscellaneous No.26455 of 2017 vide order dated 07.07.2017, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs.

10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate / Successor Court, Banka, in connection with Panjwara P.S. Case No. 04 of 2016, subject to the condition that (i) one of the bailors shall be a close relative of the petitioner (ii) if the petitioner is found involved in future in similar type of case, the prosecution will be at liberty to make prayer for cancellation of bail and (iii) the petitioner would cooperate in the proceeding of the Court below.
