The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 419/420/467/120B of the Indian Penal Code.
It is alleged by the informant that petitioner no.1 transferred a piece of land in 2006 to the informant since then the informant is residing there but in 2014, the petitioner sold the same land to one Babita Devi and now the petitioners are trying to dispossess the informant and they also threatened the family members of the informant.
It is submitted by learned counsel for the petitioners
Patna High Court Cr.Misc. No.25303 of 2015 (2) dt.10-07-2015 2/2 that the petitioner no.1 transferred some part of plot no.1813 to the informant and he sold some part of plot no.1812 to Babita Devi, hence, the petitioner has not sold the same land to Babita Devi which was sold to the informant. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the nature of accusation, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Madhepura in connection with Kumarkhand P.S. Case No.19 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
