The petitioner has been in custody since 15.12.2017 in connection with Baghaila P.S. Case No. 75 of 2017 registered for the offences punishable under Sections 25(1-b), 26 and 35 of the Arms Act.
Learned counsel for the petitioner submits that he has been made an accused under Section 302/34 of Indian Penal Code and 27 of the Arms Act in Nokha (Baghaila) P.S. Case No. 16 of 2018, after he was taken into custody in connection with the present case. It is further submitted that even the case has been occasioned on account of the fact that the petitioner was having differences with certain co-villagers, they had implicated him in the present case under Arms Act. Patna High Court Cr.Misc. No.36720 of 2018 (2) dt.17-07-2018 2/2 petitioner submits that there was no recovery from the conscious possession of the petitioner and, therefore, the petitioner may be extended the privilege of bail.
Considering the period of custody and that the other case which has been referred to in paragraph No. 3 is subsequent to the case and on the said date, the petitioner was already in custody, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sasaram (Rohtas) in connection with Baghaila P.S.
