Mr.Umeshanand Pandit ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-03-2019 The petitioners apprehend their arrest in connection with Shikarpur P.S.Case No. 106 of 2018 registered under Section 302/34 of the Indian penal Code.

Petitioners are named in the FIR and there is allegation against other co-accused persons is that one of them exhorted Rainful Mian to kill the deceased upon which Rainful Mian shot fire by his pistol at brother of the informant due to which he succumbed to injury.

Submission of learned counsel for the petitioners is that at best according to FIR, they are members of mob and they have been falsely implicated in this case as earlier they were witnesses in another case against the informant and his family

Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah, West Champaran in connection with Shikarpur P.S. Case No. 106 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sujit/- U T
