JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-11-2022 Though, the present writ petition has been filed for quashing the notice dated 15.09.2021, issued by the Circle Officer, Begusarai, i.e. the respondent no. 6, however, the learned counsel for the petitioners seeks liberty on behalf of the

Patna High Court CWJC No.4718 of 2022(2) dt.28-11-2022 2/2 petitioners to file appropriate reply/objections to the aforesaid notice dated 15.09.2021 and till the passing of the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, seeks some protection.

Having regard to the limited prayer made by the petitioners in the present writ petition, I deem it fit and proper to dispose off the present writ petition with liberty to the petitioners to file appropriate reply/objections to the aforesaid notice dated 15.09.2021 before the respondent no. 6, within a period of four weeks from today, which shall be considered by the respondent no.6, in accordance with law and the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956 shall be passed thereon, forthwith and till then status quo existing as on today qua the land/houses of the petitioners in question shall be maintained.

The writ petition stands disposed off on the aforesaid terms.
