Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 149, 323, 302 of the Indian Penal Code.

There is general and omnibus allegation against nine accused persons, to have committed assault with Lathi etc to the uncle of the informant, as a result whereof, he died subsequently.

Submission is that co-accused-Sheo Pujan Singh and Makhanchu Singh were allowed bail by a Coordinate Bench of this Court vide Annexure-2 after perusal of the case diary, which revealed that specific attribution of commission of injury at the head of the deceased was against co-accused-Pramod Singh and head injury was cause of death.

Patna High Court Cr.Misc. No.39031 of 2018 (3) dt.19-07-2018 2/2 Finding substance in submission aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bhabua Police Station Case No.360 of 2008, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
