Petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2018.

Petitioner was cleaner of the Truck from which liquor was recovered. Petitioner has stated on oath that he has got no criminal antecedent. The driver of the Truck has already been allowed bail by a Coordinate Bench of this Court as submission was that driver had no knowledge about the consignment loaded on the Truck.

Considering the facts of this case, let the petitioner, above named, be released on bail after framing of the charges

Patna High Court CR. MISC. No.26912 of 2021(2) dt.27-09-2021 2/2 so that the trial may not hamper on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Phulparas Police Station Case No.61 of 2021with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
