JUSTICE MADHURESH PRASAD ORAL JUDGMENT Date : 22-04-2019 Petitioner has filed writ petition claiming that he ought to have been awarded higher marks than what was awarded to him in Combined Competitive Examination conducted by the Bihar Public Service Commission.
Respondents have filed counter affidavit whereby specific stand is that the petitioner had secured 793 marks whereas cut off mark was 820 in his reserved category of backward class. Claim of the petitioner for revaluation and reassessment of his mark based on the basis of self serving assessment can not be allowed by this court. More so, in absence of any attribution of
Patna High Court CWJC No.12254 of 2014 dt.22-04-2019 2/2 specific malafide, writ petition does not disclose any issue worth consideration.
Apart from that this court also takes note of the fact that the petitioner had appeared in 53rd to 55th combined joint competitive examination in the year 2011. In the meantime, many competitive examinations have already been conducted thereafter by the respondent-commission. Due to lapse of time also, writ petition has become infructous.
Writ petition is dismissed.
