Mr.Mohammed Arif ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 23-09-2020 Heard learned counsel for the petitioner and Md. Arif, learned Additional P.P. through video conferencing. The petitioner apprehends his arrest in Samastipur (Town) P.S. Case No.245 of 2015, registered under Sections 406, 420, 467, 468, 471, 506, 120(B) and 34 of the Indian Penal Code.

The informant alleged that Rajesh Raushan introduced four persons, namely, Prem Kishore Singh, Dilip Kumar Singh, Anil Kumar Singh and Pankaj Singh as the land owners. The informant gave Rs.4,80,000/- to Rajesh Raushan who handed over the same to the alleged land owners. The sale deed was presented before the Registrar but the alleged land owners fled away.

Learned counsel for the petitioner submits that the petitioner is innocent and he has in fact committed no offence. The petitioner has falsely been implicated in the case. The informant has already compromised the case with Rajesh

The petitioner is alleged to have impersonated as Pankaj Singh, one of the land owner, but there is no allegation of receiving money by the petitioner. Rajesh Raushan has already compromised the case. It was Rajesh Raushan who received money from the informant.

Taking into consideration the facts aforesaid and the fact that Rajesh Raushan, who introduced the petitioner and other land owners and had received money from the informant, has been enlarged on anticipatory bail, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Samastipur in connection with Samastipur (Town) P.S. Case No.245 of 2015, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
