2. In this case, the petitioner is seeking regular bail in connection with Biraul P.S. Case No. 398 of 2024, registered for the offences punishable under Sections 310(4), 310(6), 310(5), 317(5), 61(2) of the BNS and 25(1-b)a, 26/35 of the Arms Act.

3. As per allegation, the police got an information that the accused persons of Badgaon P.S. Case No. 16 of 2024 are present in the house of co-accused Aman Kumar Jha @ Bambam Jha. The police raided his house and the named accused persons were arrested. Some arms and ammunition were recovered from their possession.

4. The learned counsel for the petitioner has

Patna High Court CR. MISC. No.16838 of 2025(3) dt.12-05-2025 2/2 submitted that the petitioner is a innocent and has falsely been implicated in this case. Some arms and ammunition were recovered from the possession of other co-accused persons and not from the possession of this petitioner. Only a mobile set was recovered from his possession. The petitioner is under custody since 24.10.2024.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Biraul P.S. Case No. 398 of 2024, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) The petitioner shall physically appear before the learned court below on each and every date till framing of the charges.
