JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-05-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 406, 420, 120B of the Indian Penal Code.

The prosecution case is that the informant purchased 10 dhurs of land appertaining to Khata No. 412, plot No. 648 from Shanti Devi, wife of Late Keshav Prasad Sinha but the said land was transferred by the Mohan Kumar, son of Shanti Devi, in favour of Sunita Devi, petitioner No.1. It is alleged that Shanti Devi died on 20.10.2014 and hence, the petitioners hatched a conspiracy and through forgery got executed sale deed

Patna High Court Cr.Misc. No.19789 of 2016 (2) dt.04-05-2016 2/2 in favour of petitioner No.1.

It is submitted by the learned counsel for the petitioners that petitioner No.1 is bonafide purchaser whereas no transfer has been made in favour of petitioner No.2 and no specific accusation has been levelled against petitioner No.3.

Considering that thrust of accusation is against Mohan Kumar, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Hajipur (Town) P.S. Case No. 66 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
