JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-03-2019 Petitioner seeks bail in anticipation of his arrest in connection with Roushan Ganj (Bankey Bazar) P.S. Case No. 13 of 2019, registered for the offences punishable under Sections 341, 323, 379, 504/34 of the Indian Penal Code and Section 37(b)(c) of Bihar Prohibition and Excise Act. Allegation against the petitioner is that he along with other accused persons intercepted the informant and snatched Rs.3,000/- from him while he was coming from his shop. Submission of learned counsel for the petitioner is that though he has been named but nothing has been recovered from his possession and he has no criminal antecedent. Heard learned APP also.

Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of

Patna High Court CR. MISC. No.15683 of 2019(2) dt.26-03-2019 2/2 anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which shall be considered on the basis of materials available on the record and, if possible, to be disposed of on the same day.

With the above observation, this application is disposed of.
