Earlier prayer for bail of the petitioner was rejected by this Court in Cr.Misc.No. 24204 of 2017, vide order dated 10.7.2017 with a direction to the court below to examine the victim girl and petitioner was given liberty to renew his prayer for bail.
Submission of learned counsel for the petitioner is that the victim girl has been examined in court, which is Annexure-5, and she has stated that she has married and she has one daughter also from the petitioner and she has also stated that she had gone on her own sweet will.
Heard learned APP and learned counsel for the informant. They have opposed the prayer for bail. Having heard both sides and in view of the facts and circumstances, let the petitioner, above named, be released on bail
Patna High Court Cr.Misc. No.48178 of 2017 (2) dt.11-10-2017 2/2 on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Jehanabad, in connection with Sessions Trial No.338 of 2017, arising out of Kako P.S.Case No. 13 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties in the jurisdiction of court concerned, (2) Petitioner shall co-operate in trial and appear on each and every date fixed in court and failure to appear on two consecutive dates without any genuine reason or without permission of court, his bail bond shall be liable to be cancelled, (3) Petitioner will not induce any witness and tamper with the evidence.
