JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-09-2015 Heard learned counsel for the petitioners and learned counsel representing the State.

Petitioners apprehend their arrest in connection with Jokihat (Mahalgaon) P.S. Case No. 363 of 2012 registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 307, 353, 332, 224, 225, 337, 504 of the Indian Penal Code. At the very outset, it has been submitted that in this case co-accused Alam @ Md. Alam who is named at serial no. 13 in the FIR has been allowed pre-arrest bail by another Bench of this Court vide order dated 21.03.2015 passed in Cr. Misc. No. 3511 of 2014 and, as such, the petitioners having no specific allegation have been named as only members of mob may be also

Patna High Court Cr.Misc. No.24609 of 2015 (3) dt.10-09-2015 allowed pre-arrest bail to which the learned APP opposes. In the facts and circumstances stated above, considering against the petitioners there is no specific allegation, the petitioners named above, in case of their surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Araria in connection with Jokihat (Mahalgaon) P.S. Case No. 363 of 2012, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
