2. The petitioner apprehends his arrest in connection with Chakiya P.S. Case No. 265 of 2024, registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 303(2), 74, 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per allegation, the petitioner along with other co-accused persons assaulted the informant's son. Further, they also snatched gold chain and cash of Rs. 45,000/- from them.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. So far as the allegation of assault on the head of son of the

No.15612 of 2025(2) dt.02-04-2025 2/2 informant is concerned that is against co-accused, Sohan Yadav and Rahul Yadav and the specific allegation to assault the informant is against Rahul Yadav. So far as this petitioner is concerned, there is allegation of snatching a gold chain and Rs. 45,000/-. The petitioner is a person of clean antecedent and there is no explanation of delay in lodging the F.I.R.

5. On the other hand, learned APP for the State opposes the prayer for bail of the petitioner.

Considering the above-mentioned facts and circumstances especially the clean antecedent of the petitioner, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, East Champaran at Motihari in connection with Chakiya P.S. Case No. 265 of 2024, subject to the conditions as laid down under Section 438(2) Cr.P.C.
