JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Sections 307/34 of the Indian Penal Code.

As per prosecution case, the petitioner along with other accused persons are said to have resorted firing upon the informant.

It is submitted by the learned counsel for the petitioner that the petitioner has falsely been implicated in this case due to village rivalry. It is further submitted that nothing specific has been attributed against the petitioner. The petitioner is in custody since 26.05.2017 having clean antecedent. It is further submitted that similarly situated co-accused has been granted bail by a coordinate Bench of this Court vide order dated 11.08.2017 in Cr.

Patna High Court Cr.Misc. No.40063 of 2017 (2) dt.24-08-2017 2/2 Misc. No. 38207 of 2017.

Heard learned A.P.P. also.

Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Begusarai in connection with Bakhari P.S.Case No. 61 of 2017, subject to the condition that one of the bailors should be a local person having sufficient immovable properties within the jurisdiction of court concerned.
