JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-06-2018 Heard learned counsel for the petitioners and State. The petitioners are in custody in connection with Excise Case No. 798 of 2018 (arising out of Pawna P.S. Case No. 24 of 2018) for the offences under Sections 413/414 of the Indian Penal Code and under Sections 30(a), 36, 44 of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioners submits that the petitioners are in custody since 11.05.2018 in connection with seizure of 15 litres Mahua liquor.
Considering the fact that the 15 litres Mahua liquor was seized from the conscious possession of these two petitioners and they have remained in custody for more than one and half
Patna High Court Cr.Misc. No.37094 of 2018 (2) dt.28-06-2018 2/2 months, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Bhojpur, Ara in connection with Excise Case No. 798 of 2018 (arising out of Pawna P.S. Case No. 24 of 2018).
