Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in Atri P.S. Case No. 60 of 2019, registered for the offences punishable under Section 409 of the Indian Penal Code.

Petitioner is alleged to have not submitted folder file relating to appointment of panchayat teacher for the year 2003/2005 and 2006 in spite of repeated request of Vigilance Unit, Gaya.

It is submitted that petitioner has been falsely implicated in this case. Petitioner has not received any folder

Patna High Court CR. MISC. No.15000 of 2020(2) dt.02-07-2020 2/2 file from his Predecessor relating to appointment of panchayat teacher. Moreover, petitioner has not made any appointment of panchayat teacher during his tenure. Petitioner has got clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Xth, Gaya in connection with Atri P.S. Case No. 60 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
