The petitioner is apprehending his arrest in connection with Simri Bakhtiyarpur P.S. Case No. 191 of 2018 registered for the offence under Section 392 of the Indian Penal Code. The informant alleged that some unknown criminals robbed his two mobile sets having Jio and B.S.N.L. sims and his Aadhar card, ATM card, PAN card and driving license on the point of weapon.

Learned counsel for the petitioner that name of the petitioner has transpired during investigation in the confessional statement of co-accused Md. Safaraj and Sahjahan and there is land dispute between the petitioner and co-accused. It is further submitted that petitioner having no criminal antecedent is

Learned APP representing the State has opposed the prayer of anticipatory bail of the petitioner. Considering the facts and circumstances of the case wherein it is stated that the petitioner has got no criminal antecedent and nothing incriminating has been recovered from possession of the petitioner and there is land dispute between the petitioner and co-accused, let the petitioner above named, in case of his arrest or surrender within a period of four weeks from today in connection with Simri Bakhtiyarpur P.S. Case No. 191 of 2018, be enlarged on bail on furnishing of bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
