====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 27-06-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a complaint case wherein cognizance has been taken under Section 498(A) of the Indian Penal Code.

The basic accusation is of torture and making assault for non-fulfillment of dowry demand.

It appears that vide order dated 03.02.2022, notices were issued to the complainant/O.P. No. 2 for her appearance before this Court but in spite of valid

It is submitted by learned counsel for the petitioner that petitioner is husband of the complainant. It is further submitted that a good sense has prevailed between the spouses and the petitioner and the complainant are happily living together as husband and wife, though a statement to that effect has not been made in petition nor any supplementary affidavit to that effect has been filed by the petitioner.

Considering the fact that petitioner and complainant are living together as husband and wife, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai in connection with Complaint Case No.

Patna High Court CR. MISC. No.27429 of 2021(3) dt.27-06-2022 3/3 1114(C) of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
