JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-05-2022 At the outset, learned counsel for petitioner seeks permission to make correction in the prayer portion of petition. Permission is accorded. The necessary correction be done during course of the day.

Heard both parties.

The petitioner seeks bail in Giriyak (Katari Sarai) P.S. Case No. 16 of 2022, registered for the offence punishable under Section 420 and other allied sections of the Indian Penal Code and section 66(C) and 66(D) of the Information Technology Act.

As per the prosecution case, on secret information that this petitioner along with associates were doing fraud by hacking data of the customers by using fake SIMs and accounts a raid was conducted. This petitioner was apprehended and on

Patna High Court CR. MISC. No.15951 of 2022(2) dt.17-05-2022 2/2 search, one mobile phone, name of customers and their mobile number, order sheet and one diary has been recovered from possession of this petitioner.

It is submitted on behalf of the petitioner that petitioner has been arrested only on suspicion. Nobody has come forward to say that these persons are cheated by this petitioner. Petitioner claims clean antecedent and he is in custody since 15.01.2022. Investigation is complete. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Biharsharif, Nalanda in connection with Giriyak (Katari Sarai) P.S. Case No. 16 of 2022.
