Learned counsel for the petitioners is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 448, 341, 323, 307, 504, 506/34 of the Indian

Patna High Court CR. MISC. No.27356 of 2021(2) dt.01-02-2022 2/3 Penal Code.

It is alleged that all the accused persons including the petitioners armed with lathi, danda, iron rod entered into the house of the informed when on the order of petitioner No. 2, co-accused Sandeep assaulted with iron rod to Rajesh Kumar and Rakesh Kumar, as a result of which they sustained injuries. It is further alleged that when Tarkeshwar Singh came to their rescue, he was assaulted by co-accused Vivek Singh. It is submitted by learned counsel for the petitioners that in the background of some land dispute, the present F.I.R has been registered. There is counter version of the occurrence also. Moreover, the injuries have been found to be simple in nature. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

Case No. 273 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
