Petitioner is in custody in connection with Madhepura (Bharahi) P.S. Case No. 174 of 2018 for the offence under section 30(a) of Bihar Prohibition Excise Act. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He is in custody since 2.4.2018.

Learned counsel further submits that in the instant case in connection with seizure of total 52 liters of liquor the petitioner is languishing in jail only on account of suspicion. He submits that nothing was recovered from the possession of the petitioner and the seizure list was not prepared in accordance with law.
