In this case, the petitioner is seeking regular bail in connection with Makhdumpur P.S. Case No. 559 of 2019 registered for offence punishable under sections 302 and 380 read with section 34 of the Indian Penal Code. The dead body of the father of the informant has been recovered, who was posted as Night Guard. During investigation, the police found that the mobile, which was recovered from his possession, was found in the tower location of rice mill godown, which is standing in the name of the mother-in-law of the petitioner but the police recovered it from the pocket of the petitioner.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.13981 of 2020(4) dt.23-02-2021 2/2 petitioner is in custody since 30.12.2019 for more than one year, having clean antecedent.

Looking to the period of custody, let the petitioner above named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in connection with Makhdumpur P.S. Case No. 559 of 2019, subject to the condition that one of the bailors of the petitioner shall be his close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. In case of failure on two consecutive dates, the court below will have liberty to take decision in accordance with law.
